Time to Get a Handle on New Hands-free Driving Laws

The law relating to mobile phone usage has been tightened up due to the wide variety of functions that can be performed on a smart phone.

Drivers of all vehicles need to focus on the implications of changes to the mobile phone laws, which were introduced in March. The impact of getting things wrong are greatest for commercial drivers whether they drive an HGV, bus and coach or van.

It is now illegal to use a handheld mobile phone while driving under virtually any circumstance.

The only time at which a driver will be allowed to touch their device will be in an emergency situation or when using it for contactless payment, at a time when the vehicle is virtually stationary and somewhere such as a car park or drive-through coffee outlet.

A device can be used for navigation, only when in a cradle. Hands-free devices, including sat navs and Bluetooth headsets, can continue to be used, as long as the driver does not hold them.

The new law carries strong penalties with fines up to £2,500, points on your driving licence, a court appearance and a minimum four-week suspension from professional driving!

As an Operator licence holder you may also face action from a Traffic Commissioner if one of your driving employee’s is caught using a handheld device behind the wheel.
This has big implications for all drivers and is something that the army of new courier drivers, who emerged during the pandemic, should perhaps particularly note.

Take note of the new law and amend any unsafe driving behaviours in relation to your mobile devices, also note that having penalty points on your licence can impact your insurance.
